Recursos del constitucionalismo cubano/Cuban Constitutionalism Resources: The "Apunta No" ["Vote No"] Campaign



 As part of the Coalition for Peace & Ethics's Technical Assistance Project--Reforma de la Constitución del Estado cubano 2018/Reform of the Cuban State Constitution 2018, we have been considering the popular response to the invitation by the Cuban State and the vanguard Communist Party (PCC) for the masses to debate the new constitutional draft recently circulated after it was approved by the National Assembly.  That debate and the suggestions gleaned from a process of well managed consultation, is expected to produce a revised final draft to be offered for approval by the nation in a popular referendum scheduled for 2019. 

In a prior post (Recursos del constitucionalismo cubano/Cuban Constitutionalism Resources: Comentarios del Extranjero y de la Prensa Independiente/Commentaries from Abroad and the Independent Press) we considered earkly reactions from the Cuban population living abroad and from the independent press.  Most interesting, for our purposes here, was the commentary of Jorge Sanguinetty (Oportunidades del debate constitucional en Cuba, published in Diario de Cuba on 9 August 2018). For Sanguinetty, the current Cuban constitutional moment serves as a test of the ability of the independent sector to organize, as well as an opportunity to practice important  forms of collective action and engagement.

Indeed, Sanguinetty may have been right. It was only a matter of time before  organizations that oppose one aspect or another of the Cuban state or its political principles would come together to oppose  the project of constitutional reform. To that end, organized opposition has now crystallized into a program of action.  Recently a civil society organization calling itself the Foro Antitotalitario Unido (FANTU) [The United Anti-Totalitarian Forum] was formed.  That organization, through a spokesperson, Guillermo Fariñas Hernández, has issued a Proclamation to kick off a in an "Apunta No"["Vote No"] campaign. It's object is to convince Cuban voters to reject the constitutional reforms during the popular referendum scheduled for early 2019.  They base this on the grounds that irrespective of any input or changes, the constitutional document is fatally flawed as both instrument, and as a memorialization of a will of the people that can be understood as legitimate within international standards. 

It would come as no surprise, as well, that this civil society campaign exceeds the tolerance of the Cuban State apparatus and the PCC for debate and comment. FANTU reported that on 1 September 2018 one of its members was arrested in connection with the Apunta No campaign in central Cuba (Arrestado militante del FANTU en Encrucijada por APUNTA NO). Another was arrested on 4 September in central Havana for passing out anti-government videos (Arrestado militante del FANTU en Centro Habana). There are likely to be more efforts like this. To that extent Apunta No serves as a boundary marker for constitutional discourse in Cuba. And a useful one.

Como parte del Proyecto CPE de Asistencia Técnica - Reforma de la Constitución del Estado cubano 2018, la CPE considera las respuestas populares que siguen la invitación del Estado cubano y del Partido Comunista de vanguardia (PCC) a debatir el nuevo borrador constitucional recientemente distribuido después de que fue aprobado por la Asamblea Nacional. Se espera que ese debate y las sugerencias derivadas de un proceso de consulta bien administrado produzcan un borrador final revisado que se ofrecerá en un referéndum popular programado en 2019.

En un post anterior (Recursos del constitucionalismo cubano / Comentarios del extranjero y la Prensa independiente) consideramos reacciones concretas de la población cubana que vive en el exterior y de la prensa independiente cubana. Lo más interesante, para nuestros propósitos aquí, fue el comentario de Jorge Sanguinetty (Oportunidades del debate constitucional en Cuba, publicado en Diario de Cuba el 9 de agosto de 2018). Para Sanguinetty, el momento constitucional cubano actual sirve como una prueba de la capacidad del sector independiente para organizarse, así como una oportunidad para practicar formas importantes de acción colectiva y compromiso con los órganos de poder.

De hecho, Sanguinetty puede haber tenido razón. Era solo cuestión de tiempo en cuando que se organizaban individuos que se oponen a uno u otro aspecto del Estado cubano o sus principios políticos se unieran en órganos civiles para oponerse al proyecto de reforma constitucional. Con ese fin, la oposición organizada ya se ha cristalizado en un programa de acción. Recientemente se formó una organización de la sociedad civil que se autodenomina Foro Antitotalitario Unido (FANTU). Esa organización, a través de un vocero, Guillermo Fariñas Hernández, ha emitido una Proclamación para iniciar una campaña "Apunta No" ["Vote No"]. Su objetivo es convencer a los votantes cubanos de rechazar las reformas constitucionales durante el referéndum popular programado para principios de 2019. Se basan en que, independientemente de cualquier aporte o cambio, el documento constitucional es fatalmente defectuoso como instrumento político y como una conmemoración de la voluntad del pueblo cubano los de los cuales que se puede ser entendida como legítima dentro de los estándares internacionales.

Tampoco sorprendería que esta campaña de la sociedad civil exceda la tolerancia del aparato del Estado cubano y del PCC para el debate y el comentario constitutional. FANTU informó que el 1 de septiembre de 2018 uno de sus miembros fue arrestado en conexión con la campaña Apunta No en el centro de Cuba (Arrestado militante del FANTU en Encrucijada por APUNTA NO). Otro fue arrestado el 4 de septiembre en el centro de La Habana por repartir videos antigubernamentales (Arrestado militante del FANTU en Centro Habana). Veremos mas manifestaciones de este carácter entre ahora y el referéndum. Hasta ese punto, entonces, Apunta No nos sirve como útil un marcador de límites para el discurso constitucional en Cuba.

Conciudadano, cubana o cubano, APUNTA NO, cuando vayas a votar en el próximo Referendo para aprobar o no el nuevo Proyecto de Constitución de la República de Cuba, que se efectuará el venidero 24 de febrero del 2019:

. Porque no se garantiza el Derecho a que los salarios de los trabajadores y trabajadoras aumenten sistemáticamente, según vaya encareciéndose la vida cotidiana dentro de Cuba.

. Porque el Partido Comunista de Cuba (PCC) sería la máxima autoridad de la República de Cuba, cuando sus militantes son sólo el 7 % de la población cubana y que no nos representa a todos.

. Porque no tenemos Derecho a Huelga, a pesar de que los gobernantes reconocer públicamente que los salarios no alcanzan y las condiciones de trabajo no garantizan la salud o la vida.

. Porque no tenemos Derecho a Votar y Elegir Directamente por los cargos públicos, como Presidente de la República, Gobernadores, Intendentes (Alcaldes) y Jueces.

. Porque los cubanos y cubanas que residen en el exterior, no poseen el Derecho al Voto y ellos son los que han logrado que no nos muramos de hambre al enviarnos las Remesas Familiares.

. Porque los cubanos y cubanas no tienen Derecho a Cambiar al Socialismo como forma de organización social y al Partido Comunista de Cuba (PCC), si un día, la mayoría así lo decidiera.

. Porque los cubanos y cubanas no tienen Derecho a Invertir en nuestro país, residan dentro o fuera de Cuba, así sus riquezas sean bien habidas, un Derecho que sólo poseen los extranjeros.

. Porque los Tribunales Populares y sus Jueces no son independientes y neutrales del Estado Socialista, por lo que nunca actuarán contra el Gobierno y el Partido Comunista de Cuba (PCC).

. Porque no se específica, que entienden los redactores del Proyecto Constitucional y el Partido Comunista de Cuba (PCC) por Vivienda Digna y no se dan plazos para que todos la tengan.

. Porque el Partido Comunista de Cuba (PCC) sería la única entidad, que no tenga que rendir cuentas por lo que hace, pues ni a la Ciudadanía ni a nadie se le da el Derecho a cuestionarlo.

. Porque no se confirma el Derecho de los jubilados y jubiladas, a que sus pensiones crezcan sistemáticamente, según vaya encareciéndose la vida diaria al interior de Cuba.

. Porque el verdadero Poder Ejecutivo y Político en la práctica va a estar en el Partido Comunista de Cuba (PCC) y no en la Ciudadanía Cubana, la cual debe ser El Poder Supremo.

. Porque los cubanos y cubanas con medios de producción basados en la Propiedad Privada (Cuentapropistas) son discriminados y poseen menor Derecho, respecto a la Propiedad Socialista.

. Porque los cubanos y cubanas que posean ideas contrarias a las del Partido Comunista de Cuba (PCC) no se les da ningún Derecho y son discriminados como ciudadanos.

. Porque es una mentira, que las cubanas y cubanos puedan tener Prosperidad, debido a que la expansión y fortalecimiento de una Clase Media que lo podría lograr, se les prohíbe hacerlo.

. Porque no tenemos Derecho a un Tribunal de Garantías Constitucionales, para que cuando contra nosotros se incumpla la Constitución de la República de Cuba, podamos acudir al mismo. 


Compatriota, cubano y cubana, medita y reflexiona antes que votes en el Referendo y no te dejes arrebatar tu futuro con falsas promesas, siempre incumplidas en casi 60 años del mismo Gobierno.

Por favor APUNTA NO, para que no te roben tus Derechos Ciudadanos.

VOTE NO 

Cuban Citizens, VOTE NO, when you go to vote in the next referendum to approve or not the new Constitution Project of the Republic of Cuba, which will be held on February 24, 2019:

. Because it does not guarantee a right to systematic increases in the wages of workers as the cost of living increases within Cuba. 

. Because the Communist Party of Cuba (PCC) would be the highest authority of the Republic of Cuba, even though its members comprise only 7% of the Cuban population so that it does not represent us all.

. Because we have no right to strike, despite the fact that the officials publicly recognize that wages do not suffice and working conditions do not guarantee health or life.

. Because we do not have the Right to Vote and to Choose Directly for public office, for example  President of the Republic, Governors, Intendants (Mayors) and Judges.

. Because Cubans who live abroad do not have the right to vote and they are the ones who have made it possible that we do not starve by sending us family remittances.

. Because Cubans have no right to change socialism as a form of social organization or the Communist Party of Cuba (PCC), if one day, a majority of the people so decided.

. Because Cubans do not have the right to invest in our country, whether they reside within or outside of Cuba, so their wealth can be well realized, a right that only foreigners have.

. Because the Popular Courts and their Judges are not independent and neutral of the Socialist State, so they will never act against the Government and the Communist Party of Cuba (PCC).

. Because there is no specific provision for dignified housing,  as the drafters of the Constitutional Project and the Communist Party of Cuba (PCC) understand, and there are no deadlines for everyone to have such housing.

. Because the Communist Party of Cuba (PCC) would be the only entity that does not have to be accountable for what it does, because neither the Citizenship nor anyone is given the right to question it.

. Because the right of retirees and retirees is not confirmed, including a guarantee that their pensions grow systematically, as daily life becomes more expensive in Cuba.

. Because the true Executive and Political Power in practice will be in the Communist Party of Cuba (PCC) and not in the Cuban Citizenship, which should be The Supreme Power.

. Because Cubans with access to means of production based on Private Property (Self-Employed) are discriminated against and have less Right as compared ot the rights enjoyed by Socialist Property.

. Because Cubans who have ideas contrary to those of the Communist Party of Cuba (PCC) are not given any rights and are discriminated against as citizens.

. Because it is a lie, that Cubans and Cubans can enjoy Prosperity, because the expansion and strengthening of a Middle Class that could achieve prosperity is forbidden.

. Because we have no right to a Tribunal to protect Constitutional Guarantees, so that when our rights under  the Constitution of the Republic of Cuba are violated, we can rely on it.


Fellow citizens, meditate and reflect before you vote in the referendum and do not let yourself be swayed by false promises, always unfulfilled during the almost 60 years of the same government.

Please VOTE NO, so they do not steal your Rights as Citizens.
