The law of collaboration, and the mechanics of its investigation, and punishment, will likely break new ground. These efforts will be developed under the shadow of an international human rights regime substantially different from that of the late 1940s. It is for that reason that the issue now merits some attention--during the stage in which the law is formulated, the process of investigation and trials are developed, and the normative foundations are created. A strong and strongly human rights oriented legality of collaboration and its punishment will make a substantial difference to Ukraine. It will have an impact on its standing within Europe and in the context of its application for membership in the EU and NATO.
It is with that in mind that one might read the text of an address delivered by President Zelenskyy of 3 October 2022: Ukraine appreciates people, saves people – these are fundamental rules for our state – address by President Volodymyr Zelenskyy. The address follows below. Its most interesting insight is contained in this portion of the address:
This is actually very important. Russian propagandists intimidate people in the areas still under the control of the occupiers that Ukraine will allegedly consider almost everyone who remains in the occupied territory as collaborators. Absolute nonsense.
Our approach has always been and remains clear and fair. If a person did not serve the occupiers and did not betray Ukraine, then there is no reason to consider such a person a collaborator. These are elementary things. If the teacher remained a Ukrainian teacher and did not lie to the children about who is the enemy... Or if a person remained a Ukrainian employee of the Ukrainian utilities service and, for example, helped preserve the energy supply for people, then such a person cannot be blamed for anything.
Hundreds of thousands of our people were in the temporarily occupied territory. Many helped our military and special services. Many simply tried to survive and waited for the return of the Ukrainian flag. Of course, there were those who betrayed Ukraine. But such cases are quickly established by the Security Service of Ukraine and are not massive. Russia did not meet mass support in Ukraine, and this is a fact. Of course, the test will come not in the construction of a narrative cage to legitimate collaboration prosecutions, but in the legal structures developed to apply its objectives fairly and within the expectations of internationally recognized human rights. The Institute for War and Peace Reporting has produced a nice summary of the current state of the law of collaboration in Ukraine:
Article 111 of the Criminal Code of Ukraine (CCU) addresses collaborationism, as it defines high treason as an act wilfully committed by a citizen of Ukraine that can include joining the enemy under martial law or armed conflict, espionage, assistance in subversive activities against Ukraine provided to a foreign state, a foreign organisation or their representatives. . . . Ukraine’s criminal system did not have provisions about collaborationism until March this year. Drafts to criminalise collaborationism were presented by lawmakers in 2017, 2019 and 2021, but they were unsuccessful.
Until March 2022, collaborationism was prosecuted under three articles of the CCU. Under these provisions there are 96 open investigations under Article 109, about actions aimed at forceful change or overthrow of the constitutional order or takeover of government. A further 8,567 investigations are ongoing under Article 110, which regulates trespass against Ukraine’s territorial integrity and inviolability. An additional 1,544 investigations are open under Article 111, about high treason. This changed with the start of the Russian invasion and the addition of two key provisions:
On March 15 2022, the CCU was updated with article 111-1 to prosecute “collaborative activity”. It aims to criminalise acts that facilitate Russian aggression and armed conflict against Ukraine and “to ensure fair punishment for persons that cooperate with an aggressor-state and to deprive them the right to occupy certain positions or engage in certain activities”.
On April 23 2022, the CCU was updated with article 111-2. The Accessory to Aggressor-State article aims to criminalise support to Russia in carrying out aggression and armed conflict against Ukraine and “to ensure fair punishment for accessory to aggressor-state and to deprive the right to occupy certain positions or engage in certain activities”. The possibilities of an overbroad and punitive application of the provisions may present a challenge. As detailed in the interview it might be possible to read these provisions in light of the CCU’s Article 40 details exceptions to a criminal action because of physical violence or mental coercion. But this is new legal territory.
Equally important will be the way that the new law will be applied not to individuals (the expected focus of prosecution) but to business enterprises. In that case, guidance of the UN Guiding Principles for Business and Human Rights, and especially the application of the principles to conflict zones may provide a framework for interpreting and applying Ukrainian statutes. Indeed, it is to be hoped that the UNGPs may be useful in developing a human rights sensitive jurisprudence of collaboration that extends beyond individuals to enterprises. The challenge for Ukraine will be to make good on President Zelenskyy's core principle--that the collaboration statutes ought to be tied to the fundamental principle of substantial betrayal that evidences positive acts not merely of renunciation of past allegiances but positively evidences active support of the forces of the invader in ways that substantially damage either the state or the welfare of the people. More telling will be the ability of Ukrainian authorities to prevent collaboration to be used by people (or officials) to settle old private score under cover of these provisions. A big challenge but the first step has already been taken.

Today, I will also begin my address with a message about what happened in Türkiye.
Finally, we managed to organize a meeting of our boys, commanders from "Azovstal", with their relatives. The meeting is in Türkiye, where our warriors stay in accordance with the agreement on their release.
They are completely safe – with the guarantees of President of Türkiye Erdoğan. They are provided with proper conditions. And now they can see their relatives.
They have not seen each other for many months. And now I thank everyone who made it possible for them to be with their families again.
And we will do everything to make such a meeting possible for the families of all Ukrainians who are still in Russian captivity one day – a meeting with their relatives.
Ukraine appreciates people. Saves people. And helps all those who need help. These are fundamental rules for our state. And it will always be so.
A large group of our officials continues the work on providing the necessary assistance to all those released from Russian captivity. As you understand, there are a lot of issues. This is not only treatment and rehabilitation, but also a large volume of social issues, often legal. The state will certainly help solve all of them.
At the same time, everything is being done quite intensively at various levels of government to restore normal life in the areas liberated from the occupiers.
In total, these are more than 450 settlements in the Kharkiv region alone – those that were liberated thanks to the defense operation that began in September and is still ongoing.
The work of transport, post office, police, normal supply of water, gas, electricity is being restored – as much as possible. The occupiers left many mined areas, many tripwires, almost all infrastructure was destroyed. The damage is colossal.
But life is returning – it is returning wherever the occupiers were driven out. We also make social payments – pensions, salaries. In particular, to the teachers who remained loyal to Ukraine and did not switch to the curriculum of the occupiers.

Today, the offensive movement of our army and all our defenders continued. There are new liberated settlements in several regions.
Fierce fighting continues in many areas of the front. But the perspective of these hostilities remains obvious - more and more occupiers are trying to escape, more and more losses are being inflicted on the enemy army, and there is a growing understanding that Russia made a mistake by starting a war against Ukraine.
Of course, there are many fanatics out there. Those who will never admit the obvious, that this is a pointless war for Russia that Russia cannot win. Because it is impossible to defeat a nation that preserves unity and knows what they are fighting for.
The same cannot be said about the people of Russia as about the Ukrainian people. None of those who are now being sent to war after criminal mobilization will be able to explain: what is the point of this for him personally? Why should he risk his life?
Among the dead occupiers we can already see those who were taken just a week or two ago. People were not trained for combat, they have no experience to fight in such a war. But the Russian command just needs some people - any kind - to replace the dead. And when these new ones die, more people will be sent. This is how Russia fights. That's how it will lose as well.
No sham referenda, announcements about annexations, conversations about the borders they invented and drew somewhere, will help them.
There is a clear and internationally recognized border of Ukraine. There are lives we must protect. There is security we must restore. And all this will happen. We are doing all this.
And one more thing.
Today, Russia was ultimately removed from decision-making in world aviation. There will be no more representatives of the terrorist state in the governing body – the Council of the International Civil Aviation Organization. This is a crucially important world institution, a specialized agency of the UN, and this is a quite eloquent signal to all other international organizations.
A state that has violated so many norms of international law cannot be kept in any international organizations as a supposedly normal participant. Russia has no place in the global community.

Українці! Українки!
Сьогодні теж почну своє звернення з повідомлення про те, що відбулося в Туреччині.
Нарешті нам вдалося організувати зустріч наших хлопців, командирів з «Азовсталі», з рідними. Зустріч саме в Туреччині, де наші воїни перебувають згідно з домовленістю про їхнє звільнення.
Вони в повній безпеці – з гарантіями Президента Туреччини Ердогана. Їм забезпечені належні умови. І тепер вони можуть бачитися зі своїми рідними.
Вони не бачилися протягом довгих місяців. І ось тепер я дякую всім, хто забезпечив їм можливість знову бути зі своїми родинами.
І ми зробимо все, щоб для родин усіх українців, які ще перебувають у російському полоні, одного дня стала можливою така зустріч – зустріч з рідними.
Україна цінує людей. Рятує людей. І допомагає всім тим, хто потребує допомоги. Це фундаментальні правила для нашої держави. І так буде завжди.
Велика група наших посадовців продовжує роботу з надання необхідної допомоги усім, хто був звільнений з російського полону. Питань, як ви розумієте, дуже багато. Це не тільки лікування та реабілітація, а й великий обсяг соціальних питань, часто – юридичних. Держава обовʼязково допоможе усі їх розв’язати.
Водночас доволі інтенсивно на різних рівнях влади робиться все, щоб повернути нормальне життя у звільнені від окупантів райони.
Загалом це понад чотири з половиною сотні населених пунктів в одній лише Харківській області – ті, що були звільнені завдяки оборонній операції, що почалась у вересні й досі триває.
Відновлюється робота транспорту, пошти, поліції, нормальне постачання води, газу, електрики – настільки, наскільки це можливо. Після окупантів залишилося багато замінованих ділянок, багато розтяжок, майже вся інфраструктура зруйнована. Збитки колосальні.
Але життя повертається – повертається всюди, де вигнали окупантів. Здійснюємо й соціальні виплати – пенсії, зарплати. Зокрема й учителям, які були вірними Україні та не перейшли на програму окупантів.
Це насправді дуже важливо. Російські пропагандисти залякують людей у районах, які поки що контролюють окупанти, що Україна нібито вважатиме колаборантами ледве не всіх, хто залишився на окупованій території. Абсолютна маячня.
Наш підхід завжди був і залишається чітким і справедливим. Якщо людина не служила окупантам і не зрадила України, то немає підстав вважати таку людину колаборантом. Це елементарні речі. Якщо вчитель залишився українським учителем і не брехав дітям про те, хто ворог... Або якщо людина залишилась українським працівником української комунальної служби і, наприклад, допомагала зберегти енергопостачання для людей, то не можна в чомусь таку людину звинувачувати.
Сотні тисяч наших людей перебували на тимчасово окупованій території. Багато хто допомагав нашим військовим і спецслужбам. Багато хто просто намагався вижити й чекав, коли повернеться український прапор.
Звичайно, були й ті, хто зрадив Україну. Але такі випадки доволі швидко встановлюються Службою безпеки України та не є масовими. Росія не зустріла масової підтримки в Україні, і це факт.
Сьогодні продовжився наступальний рух нашої армії, усіх наших захисників. Є нові звільнені населені пункти в кількох областях.
Тривають жорсткі бойові дії на багатьох ділянках фронту. Але перспектива цих бойових дій залишається очевидною – дедалі більше окупантів намагаються втекти, дедалі більше втрат зазнає ворожа армія, дедалі більше розуміння того, що Росія зробила помилку, пішовши війною проти України.
Звичайно, там є багато фанатиків. Тих, хто ніколи не визнає очевидну річ, що це безглузда війна для Росії, у якій Росія не може перемогти. Бо неможливо перемогти народ, який зберігає єдність і знає, за що воює.
Про народи Росії не можна сказати такого ж, як про український народ. Ніхто з тих, кого зараз відправляють на війну після злочинної мобілізації, не зможе пояснити: а навіщо це йому особисто? Чому він повинен ризикувати своїм життям?
Ми бачимо вже зараз серед загиблих окупантів і тих, хто був забраний просто тиждень чи два тому. Людей не готували до бойових дій, у них немає жодного досвіду, щоб воювати на такій війні. Але російському командуванню просто потрібні якісь люди – і будь-які, щоб поставити їх на місце загиблих. А коли й ці нові загинуть, відправлять іще людей. Так воює Росія. Так вона і програє.
Їй не допоможуть якісь там псевдореферендуми, якісь там оголошення про анексії, якісь там розмови про вигадані ними кордони, які намальовані незрозуміло де...
Є чіткий і міжнародно визнаний кордон України. Є життя, яке ми повинні захистити. Є безпека, яку ми маємо відновити. І все це буде. Все це ми робимо.
І ще одне.
Сьогодні Росію остаточно відсторонили від ухвалення рішень у світовій авіації. Не буде більше представників держави-терориста в керівному органі – раді Міжнародної організації цивільної авіації. Це дуже вагома світова інституція, яка є спеціалізованою установою ООН, і це дуже промовистий сигнал усім іншим міжнародним організаціям.
Державу, яка порушила стільки норм міжнародного права, не можна зберігати в будь-яких міжнародних організаціях як нібито нормального учасника. Росії не місце в глобальній спільноті.
Я дякую всім, хто допомагає нам захищати свободу!

Украинцы! Украинки!
Сегодня тоже начну свое обращение с сообщения о том, что произошло в Турции.
Наконец-то нам удалось организовать встречу наших ребят, командиров с «Азовстали», с родными. Встреча именно в Турции, где наши воины пребывают согласно договоренности об их освобождении.
Они в полной безопасности – с гарантиями Президента Турции Эрдогана. Им обеспечены надлежащие условия. И теперь они могут видеться со своими родными.
Они не виделись в течение долгих месяцев. И вот теперь я благодарю всех, кто обеспечил им возможность снова быть со своими семьями.
И мы сделаем все, чтобы для семей всех украинцев, еще пребывающих в российском плену, однажды стала возможной такая встреча – встреча с родными.
Украина ценит людей. Спасает людей. И помогает всем тем, кто нуждается в помощи. Это фундаментальные правила для нашего государства. Так будет всегда.
Большая группа наших чиновников продолжает работу по предоставлению необходимой помощи всем, кто был освобожден из российского плена. Вопросов, как вы понимаете, очень много. Это не только лечение и реабилитация, но и большой объем социальных вопросов, часто – юридических. Государство обязательно поможет их все решить.
В то же время достаточно интенсивно на разных уровнях власти делается все, чтобы вернуть нормальную жизнь в освобожденные от оккупантов районы.
В общей сложности это более четырех с половиной сотен населенных пунктов в одной только Харьковской области – те, что были освобождены благодаря оборонной операции, которая началась в сентябре и продолжается до сих пор.
Возобновляется работа транспорта, почты, полиции, нормальная поставка воды, газа, электричества – настолько, насколько это возможно. После оккупантов осталось много заминированных участков, много растяжек, почти вся инфраструктура разрушена. Ущерб колоссальный.
Но жизнь возвращается – возвращается повсюду, где выгнали оккупантов. Осуществляем и социальные выплаты – пенсии, зарплаты. В том числе и учителям, которые были верны Украине и не перешли на программу оккупантов.
Это действительно очень важно. Российские пропагандисты запугивают людей в районах, которые пока контролируют оккупанты, что Украина якобы будет считать коллаборантами едва ли не всех, кто остался на оккупированной территории. Абсолютный бред.
Наш подход всегда был и остается четким и справедливым. Если человек не служил оккупантам и не предал Украину, то нет оснований считать такого человека коллаборантом. Это простые вещи. Если учитель остался украинским учителем и не врал детям о том, кто враг... Или если человек остался украинским работником украинской коммунальной службы и, например, помогал сохранить энергоснабжение для людей, то нельзя в чем-то такого человека винить.
Сотни тысяч людей пребывали на временно оккупированной территории. Многие помогали нашим военным и спецслужбам. Многие просто пытались выжить и ждали, когда вернется украинский флаг.
Конечно, были и те, кто предал Украину. Но такие случаи достаточно быстро устанавливаются Службой безопасности Украины и не являются массовыми. Россия не встретила массовой поддержки в Украине, и это факт.
Сегодня продолжилось наступательное движение нашей армии, всех наших защитников. Есть новые освобожденные населенные пункты в нескольких областях.
Идут жесткие боевые действия на многих участках фронта. Но перспектива этих боевых действий остается очевидной: все больше оккупантов пытаются убежать, все больше потерь несет вражеская армия, все большее понимание того, что Россия совершила ошибку, пойдя войной против Украины.
Конечно, там много фанатиков. Тех, кто никогда не признает очевидную вещь, что это бессмысленная война для России, в которой Россия не может победить. Потому что невозможно победить народ, который сохраняет единство и знает, за что воюет.
О народах России нельзя сказать такого же, как об украинском народе. Никто из тех, кого сейчас отправляют на войну после преступной мобилизации, не сможет объяснить: а зачем ему это лично? Почему он должен рисковать своей жизнью?
Мы видим уже сейчас среди погибших оккупантов и тех, кто был забран просто неделю или две назад. Людей не готовили к боевым действиям, у них нет никакого опыта, чтобы воевать на такой войне. Но российскому командованию просто нужны люди – и любые, чтобы поставить их на место погибших. А когда эти новые погибнут, отправят еще людей. Так воюет Россия. Так она и проиграет.
Ей не помогут какие-то там псевдореферендумы, какие-то там объявления об аннексии, какие-то разговоры о выдуманных ими границах, которые нарисованы непонятно где...
Есть четкая и международно признанная граница Украины. Есть жизнь, которую мы должны защитить. Есть безопасность, которую мы должны восстановить. И всё это будет. Всё это мы делаем.
И еще одно.
Сегодня Россию окончательно отстранили от принятия решений в мировой авиации. Не будет больше представителей государства-террориста в руководящем органе – совете Международной организации гражданской авиации. Это очень весомый мировой институт, который является специализированным учреждением ООН, и это очень красноречивый сигнал всем остальным международным организациям.
Государство, нарушившее столько норм международного права, нельзя сохранять в каких-либо международных организациях как якобы нормального участника. России не место в глобальном сообществе.
Я благодарю всех, кто помогает нам защищать свободу!
