For those who might be interested in signing on, a group of Spanish and other European Academics are circulating a Manifesto (the longer title above). Directiva Europea sobre Diligencia Debida de las Empresas en materia de Sostenibilidad
Los representantes de la academia que trabajamos para impulsar el control y la transparencia de las cadenas de valor consideramos que la Directiva Europea sobre Diligencia Debida de las Empresas en materia de Sostenibilidad supone una oportunidad única para establecer un marco legal que permita proteger, respetar y reparar los abusos a los derechos humanos y los daños medioambientales cometidos en el contexto de las actividades empresariales. Creemos que la directiva tiene el potencial de influir de manera decisiva en las prácticas de sostenibilidad y de respeto a los derechos humanos por parte de las empresas que operan en Europa, tanto en el territorio de la propia Unión Europea como en otros países.
La negociación entre las instituciones de la UE sobre el texto definitivo entra en su fase final durante la Presidencia Española del Consejo de la UE. Es el momento de que el gobierno español y los demás gobiernos de la UE demuestren que su compromiso es real con las personas y el medio ambiente. Para ello, solicitamos que impulsen una directiva ambiciosa y eficaz, que prevenga y ponga fin a la impunidad de muchas empresas.
Los abajo firmantes, pedimos, que se aborde de forma apropiada una serie de cuestiones fundamentales que aseguren que el texto cumpla de forma eficaz el propósito para el que ha sido concebido; así como su coherencia con los Principios Rectores sobre Empresas y Derechos Humanos (adoptados por el Consejo de Derechos Humanos de Naciones Unidas hace ya más de diez años) y con otros estándares internacionales, como las Líneas Directrices de la OCDE para Empresas Multinacionales sobre Conducta Empresarial Responsable (actualizadas en la Reunión del Consejo Ministerial de la OCDE el pasado mes de junio de 2023).
Por todas esas razones pedimos en la Directiva de debida diligencia de la UE la inclusión de las siguientes cuestiones:
A) Que se aplique a la totalidad de la cadena global de valor, dentro y fuera de las fronteras de la UE, incluyendo el conjunto de relaciones comerciales, conforme al marco normativo supranacional antes mencionado.
B) Que se incluya al sector financiero en su ámbito de aplicación.
C) Que se garanticen los derechos humanos y el medioambiente desde una perspectiva más amplia y conforme al marco normativo supranacional.
D) Que se establezcan, con carácter obligatorio, las consultas y la participación de los titulares de derechos y partes interesadas.
E) Que se garantice el acceso a la justicia impulsando la eliminación de las barreras legales y procedimentales para el acceso de las víctimas a la justicia.
F) Que se incorpore la perspectiva de género estableciendo medidas y estrategias más eficaces para la protección de los derechos de las mujeres y las niñas.

Manifest of Academy Representatives
European Corporate Sustainability Due Diligence Directive (CSDDD)
We, the academy representatives working to promote the monitoring and transparency of value chains, see the European Corporate Sustainability Due Diligence Directive as an unique opportunity to establish a legal framework to protect, respect and remedy human rights abuses and environmental damage committed in the context of business activities. We believe that the directive has the potential to have a decisive impact on the sustainability and human rights practices of companies operating in Europe, both within the European Union and beyond.
Negotiations between the EU institutions on the final text are entering their final phase during the Spanish Presidency of the EU Council. Now, it is the time for the Spanish government and other EU governments to show that their commitment to people and the environment is real. To this end, we call on them to promote an ambitious and effective directive that prevents and puts an end to the impunity of many companies.
We, the undersigned, ask that a number of fundamental issues be appropriately addressed to ensure that the text effectively fulfills the purpose for which it was conceived; as well as its consistency with the Guiding Principles on Business and Human Rights (adopted by the United Nations Human Rights Council more than ten years ago) and with other international standards, such as the OECD Guidelines for Multinational Enterprises on Responsible Business Conduct (updated at the OECD Ministerial Council Meeting last June 2023).
For all these reasons we call for the following issues to be included in the EU Due Diligence Directive:
A) It should apply to the entire global value chain, within and beyond EU borders, including all commercial relationships, in line with the above-mentioned supranational regulatory framework.
B) The financial sector should be included in its scope of application.
C) Human rights and the environment should be guaranteed from a broader perspective and in accordance with the supranational regulatory framework.
D) Consultations and participation of rights holders and interested parties should be established on a mandatory basis.
E) Access to justice should be guaranteed by promoting the elimination of legal and procedural barriers to victims' access to justice.
F) The gender perspective should be incorporated by establishing more effective measures and strategies for the protection of the rights of women and girls.
