The extraordinary Ngoc Son Bui (my interview with him here) has organized a very interesting workshop (Constitutional Law of Greater China, 9-10 December 2021, Oxford Programme in Asian Laws) around essays that will be contributed to a Handbook of Constitutional Law in Greater China that is likely to become a standard in the field and an important reference for anyone interested in issues of Chinese constitutionalism (Program here).
My own contribution touches on China's vanguard, the leading forces of the nation, organized as the Chinese Communist Party (CPC), within the Chinese constitutional order. This contribution has been made more interesting by the distribution (in English) of the State Council's White Paper: China: Democracy That Works on 4 December 2021 (original: 中国的民主 also distributed on 4 December) and its companion White Paper "The State of Democracy in the United States" (5 December 2021; Official English translation HERE); [美国民主情况] (original Chinese HERE). Discussed at greater lenfgth HERE.
Whatever its 'true' complexion, these provided a site of motivation for reaction from Chinese authorities.The distributions were timed to coincide, and perhaps detract, from the much publicized U.S. effort to host a democracy conference among the leading forces of liberal democratic constitutionalism (the "Summit for Democracy"). The three great themes of the Summit for Democracy might have been read as an effort to challenge the legitimacy of the Chinese path (defending against authoritarianism; addressing and fighting corruption; and promoting respect for human rights) and promoting anti-Chinese internationalism. It could as easily be understood as reinvigorating the conceptual basis of markets driven liberal democratic constitutionalism. But the Summit also provided a convenient backdrop against which Chinese authorities might more effectively re-focus their energies on the deeper conceptualization and projection outward of their own imaginaries of legitimate constitutional systems. Indeed, in comments proffered on the release of the State Council White Paper Tian Peiyan, the deputy director of the Communist Party's Policy Research Office took great pains to contrast the Chinese path of democratic constitutionalism with that advanced by the United States and its larger camp.
He blamed the high COVID-19 death toll in the U.S. on political disputes and a divided government from the highest to the lowest levels. Such democracy brings not happiness but disaster to voters,” he said at a news conference to release a government report on what the Communist Party calls its form of democracy, which is firmly under party control. Neither China nor Russia are among about 110 governments that have been invited to Biden's two-day virtual “Summit for Democracy,” which starts Thursday and will address strengthening democracy, defending against authoritarianism, corruption and human rights. In the same vein, Xu Lin, the vice minister of the party’s publicity department was quoted as stating that “The U.S. calls itself a ‘leader of democracy’ and organizes and manipulates the so-called Summit for Democracy," he said. “In fact, it cracks down and hampers countries with different social systems and development models in the name of democracy."China's communists bash US democracy before Biden summit)
All of this debating takes one back to basic principles in either camp. More importantly, it ought to take one back to the understanding of the fundamentally divergent ways in which Marxist Leninism and liberal democracy understand the impulse toward democratic organization and its institutionalization within quite distinct democratic collectives. Both view the other as transgressing core taboos of legitimacy. Both see in the other as necessary stage in transition toward their own way of conceiving the world and imparting meaning to basic terms and principles. Both have significant and divergent consequences both for the ordering of national collectives and for the structuring of relations among collectives in quite distinct approaches to globalization and economic production. But all of it is fundamentally attached to the core principles around which the political-economic order is established, political power is collected and delegated, and the relation of the individual to the collective is set. At the same time it is a reminder that constitutional systems, however incompatible, share a core characteristic--the institution of legitimacy framing principles and rules, of conceptual and policy taboos--that mark the difference between systems for the unimpeded exercise of discretion, from those that are bounded (strictly at least in theory) by the normative and rule constraints that reflect their fundamental character (discussed in From Constitution to Constitutionalism).
It is therefore useful to understand the conceptual basis and the theoretical framing of democratic constitutionalism around which Chinese officials have developed their own political order, now offered to the world. That is the principal objective of my contribution: ‘The

Abstract: Chinese Marxist Leninist constitutional theory has produced a constitutional order that is quite distinct from that common to the West and its baseline liberal democratic constitutional orders. Where the later starts from the premise that all sovereign power is vested in a government whose authority is ordered and constrained by a constitutional document, Chinese constitutional theory starts from the premise of the delegation of sovereign authority from the people to its leading forces constituted as a vanguard party. Administrative authority is then vested in the organs of state which accept the leadership of the Party and its guidance in the governance of the nation. This contribution examines the Chinese constitutional system within the parameters of its own political assumptions. China has moved toward a legitimately constitutionalist governance system in which power is divided between a vanguard party, which serves as the repository of political power, and the administrative organs of government. The CPC serves an institutional role within Chinese constitutionalism and also represents the political power of the Chinese polity directly in the political ordering of the government. The CPC, in turn, is constrained by the normative basis on which Chinese constitutionalism is ordered -- Marxist Leninism and Mao Zedong Thought, Deng Xiaoping Theory, the important Thought of Three Represents, the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics in the New Era Theory. These serve as the ideological basis for the Chinese political model and a constraint on the exercise of authority within both Party and state organs. Thus framed the Chinese constitutional system can be understood as both distinctly and legitimately constitutionalist. The contribution embeds the substantive political theory of Leninist constitutionalism on which the political order is organized with its expression in the organization of the state. It starts with a consideration of the Chinese state constitution. It then turns to a consideration of the constitution of the political order institutionalized within the Constitution of the Communist Party of China (CPC). In that context it examines the anti-arbitrary assertion of power principle of constitutionalism in the relationship between the administrative organs of state and the organs of CPC governance. Lastly, it situates both constitutions within the hierarchies of Chinese constitutional authority, one in which the state constitution provides the cage of regulation that embodies the CPC core Basic Line,. This last contributes to the accountability mechanisms built into the system of Chinese constitutionalism grounded on the operating premise that the CPC is at the center, the navigator and helmsman of the nation.
1. Introduction
Chinese Marxist Leninist constitutional theory is modernity’s nightmare.[1] The development of a constitutional order from out of a revolutionary movement[2] has produced a constitutionalist framework that is quite consciously distinct from that common to the West and its baseline liberal democratic constitutional orders. From liberal democratic baseline constitutional perspective, it is “the other” of constitutional theory[3]--adjudged only as a function of the ideal[4]--which for the greater portion of the established constitutional jurisprudence elite is, by their definition, some variation of late 20th century classical liberal democratic constitutionalism.[5] At best, and grudgingly, given space within the constitutional discourse as “authoritarian” constitutionalism--the (pejorative) is meant to convey a quite precise meaning making centered on its deviation (negative) from that cluster of principles and values that are expressed in concrete form as liberal constitutionalism[6] with its ancient seat in Western European and North American states after 1798. It is also the yardstick against which liberal democratic constitutional theorists in the West judge what for them are fundamentally illegitimate deviations within their own constitutional orders.[7]
The constitutionalism of liberal democratic orders start from the premise that all sovereign power is vested in a government whose authority is ordered and constrained by a constitutional document,[8] and vested in a government suitable for the times but loyal to its core premises.[9] Beyond that, and certainly in the United States, the operationalization of this core set of premises is open ended and marked by enormous disagreement, even from the start of the Republic,[10] and substantial changes over time in the popular taste for government and the self-reflexive understanding of the sovereign societal order it is meant to manifest.[11] It is from these premises, and these sometimes great contests among key political elements, that the concept of constitutionalism has been given form, and the limits of legitimate expression of the constitutionalism principle, within (or without) a written constitution is embedded in the social consciousness and then into the law and norms of international bodies.[12]
This long introductory exposition is made necessary because the power to affect global judgments about distinctions between legitimate and illegitimate constitutional orders, and even to identify a system as legitimately constitutionalist, has been a central element in Western liberal democratic approaches to the study and classification of the constitutional system of China.[13] And it has become an important element of Chinese constitutional discourse through the beginning of China’s constitutional “New Era.”[14] More importantly, perhaps, it has been instrumental in the way in which the study of such systems are prejudged as not merely a constitutional deviation, but a deviation for inconsistent with the core political principles of liberal democracy that such systems might not be understood as legitimately constitutional.[15] The object of Chinese constitutional theory, then, is sometimes reduced to a project of alignment with what is perceived to be the core expectations drawn from liberal democratic orders,[16] or as described at the start of this contribution, as its re-construction as something that mimics but cannot be constitutional, taking as its starting point the3 core tenets of liberal democratic constitutionalism.[17]
Chinese constitutional theory quite consciously[18] starts from a very different place, though it shares many of the values of liberal democratic constitutionalism investing them with a meaning derived in large measure from its own theoretical starting points.[19] It is based on the certainty that “The Flower of Democracy Blooms Brilliantly in China”[中国的民主之花绚丽绽放],[20] only that it comes from a very different conceptual space. At its core is the premise of the delegation of sovereign authority from the people to its leading forces constituted as a vanguard party. Administrative authority is then vested in the organs of state which accept the leadership of the Party and its guidance in the governance of the nation. While Chinese constitutional discourse before the New Era debated the relationship between the constitution of the vanguard, and the constitutionalization of the state apparatus, the role of the vanguard itself as a decisive and representative element within the Chinese constitutional order could not be avoided.[21] That left open only two significant terrains for debate. The first was one that looked to the nature of the scope and exercise of political authority by the CPC, the other looked to the forms that discretionary exercises of authority were either organized or constrained by the CPC’s own rules, political line or by the fundamental strictures of its objectives as a communist vanguard.
This contribution examines the Chinese constitutional system within the parameters of its own political assumptions.[22] China asserts with greater confidence that it has moved toward a legitimately constitutionalist governance system in which power is divided between a vanguard party, which serves as the repository of political power, and the administrative organs of government. But in the process it has embraced a set of core political and human values quite distinct from that at the core of liberal democratic constitutional theory, starting with the delegation of sovereign authority from the masses to its vanguard, to the constitution of state power in ways that reject liberal democratic principles of separation of powers and (judicial) review. In Chinese Leninist constitutionalism, the CPC stands at the center of the political order. The CPC serves an institutional role within Chinese constitutionalism and also represents the political power of the Chinese polity directly in the political ordering of the government. The CPC, in turn, is constrained by the normative basis on which Chinese constitutionalism is ordered -- Marxist Leninism and Mao Zedong Thought, Deng Xiaoping Theory, the important Thought of Three Represents, the Scientific Outlook on Development, and Xi Jinping Thought on Socialism with Chinese Characteristics in the New Era Theory.[23] And that, precisely is both the essence of Chinese Marxist-Leninist Constitutionalism, and its reconstruction of political power within the Leninist vanguard and through them to the apparatus of the state built to operationalize its political “line” (its policies and objective). As Stanley Lubman wrote, “although they have continued to emphasize the importance of the role of law, at the same time they also insist on maintaining the dominant role of the CPC in Chinese society, and cannot resolve the contradiction between these two policies.”[24] And yet, the essential problem of constitutionalism remains the same--the protection of systems of authority and government “against arbitrary will.”[25]
These premises serve as the ideological basis for the Chinese political model and a constraint on the exercise of authority within both the Leninist vanguard Communist Party of China (CPC) and state organs constituted under law for the purpose of exercising the popular will under the leadership of the CPC.[26] Thus framed, the Chinese constitutional system can be understood as both distinctly and legitimately constitutionalist.[27]
The contribution embeds the substantive political theory of Leninist constitutionalism on which the political order is organized with its expression in the organization of the state. It starts with a consideration of the Chinese state constitution. It then turns to a consideration of the constitution of the political order institutionalized within the Constitution of the CPC. It then it examines the relationship between the administrative organs of state and the organs of CPC governance. Lastly, it situates both constitutions within the hierarchies of Chinese constitutional authority, one in which the state constitution provides the cage of regulation that embodies the CPC core Basic Line.[28] This last contributes to the accountability mechanisms built into the system of Chinese constitutionalism grounded on the operating premise that the CPC is at the center, the navigator and helmsman of the nation one that is consonant with the core anti-arbitrary assertion of power principle at the center of constitutionalism.[29] A caveat: the discussion that follows is focused on the formal constitution of the Chinese political order manifested in its core institutions; to that end the analysis will focus on the documents authoritatively constituting both the state apparatus and the nation’s political vanguard.[30]
