坚持独立自主，就要坚持中国的事情必须由中国人民自己作主张、自己来处理。世界上没有放之四海而皆准的具体发展模式，也没有一成不变的发展道路。历史条件的多样性，决定了各国选择发展道路的多样性。人类历史上，没有一个民族、没有一个国家可以通过依赖外部力量、跟在他人后面亦步亦趋实现强大和振兴。那样做的结果，不是必然遭遇失败，就是必然成为他人的附庸。
我们党在领导革命、建设、改革长期实践中，历来坚持独立自主开拓前进道路，这种独立自主的探索和实践精神，这种坚持走自己的路的坚定信心和决心，是我们党全部理论和实践的立足点，也是党和人民事业不断从胜利走向胜利的根本保证。

一个国家选择什么样的治理体系，是由这个国家的历史传承、文化传统、经济社会发展水平决定的，是由这个国家的人民决定的。我国今天的国家治理体系，是在我国历史传承、文化传统、经济社会发展的基础上长期发展、渐进改进、内生性演化的结果。我国国家治理体系需要改进和完善，但怎么改、怎么完善，我们要有主张、有定力。中华民族是一个兼容并蓄、海纳百川的民族，在漫长历史进程中，不断学习他人的好东西，把他人的好东西化成我们自己的东西，这才形成我们的民族特色。没有坚定的制度自信就不可能有全面深化改革的勇气，同样，离开不断改革，制度自信也不可能彻底、不可能久远。我们全面深化改革，是要使中国特色社会主义制度更好；我们说坚定制度自信，不是要固步自封，而是要不断革除体制机制弊端，让我们的制度成熟而持久。

“橘生淮南则为橘，生于淮北则为枳”。我们需要借鉴国外政治文明有益成果，但绝不能放弃中国政治制度的根本。中国有960多万平方公里土地、56个民族，我们能照谁的模式办？谁又能指手画脚告诉我们该怎么办？对丰富多彩的世界，我们应该秉持兼容并蓄的态度，虚心学习他人的好东西，在独立自主的立场上把他人的好东西加以消化吸收，化成我们自己的好东西，但决不能囫囵吞枣、决不能邯郸学步。照抄照搬他国的政治制度行不通，会水土不服，会画虎不成反类犬，甚至会把国家前途命运葬送掉。只有扎根本国土壤、汲取充沛养分的制度，才最可靠、也最管用。

Independence is the inevitable conclusion of our party's revolution, construction, and reform based on China's reality and relying on the power of the party and the people. Regardless of the past, present and future, we must base the development of the country and nation on our own strength, uphold national self-esteem and self-confidence, and unswervingly follow our own path.
Independence is a fine tradition of the Chinese nation and an important principle for the Communist Party of China and the People's Republic of China to establish the party and the country. To uphold independence and self-reliance, we must insist that China's affairs must be decided and handled by the Chinese people themselves. There is no specific development model that is applicable to all countries in the world, nor is there an unchanging development path. The diversity of historical conditions determines the diversity of development paths chosen by countries. In human history, no nation or country can achieve strength and revitalization by relying on external forces and following others. The result of doing so is either inevitable failure or inevitable becoming a vassal of others.
In the long-term practice of leading the revolution, construction, and reform, our party has always insisted on independently exploring the road ahead. This independent spirit of exploration and practice, this firm confidence and determination to insist on taking its own path, is the foothold of all our party's theories and practices, and is also the fundamental guarantee for the party and the people's cause to continue to move from victory to victory.

What kind of governance system a country chooses is determined by its historical heritage, cultural traditions, and economic and social development level, and by the people of this country. my country's current national governance system is the result of long-term development, gradual improvement, and endogenous evolution based on its historical heritage, cultural traditions, and economic and social development. my country's national governance system needs to be improved and perfected, but we must have ideas and determination on how to improve and perfect it. The Chinese nation is an inclusive and tolerant nation. In the long historical process, we have continuously learned the good things of others and turned them into our own things, which has formed our national characteristics. Without firm institutional confidence, there will be no courage to comprehensively deepen reform. Similarly, without continuous reform, institutional confidence cannot be thorough and long-lasting. "Oranges grown in the south of the Huai River are oranges, while those grown in the north of the Huai River are tangerines." We need to learn from the beneficial achievements of foreign political civilization, but we must never abandon the fundamentals of China's political system. China has more than 9.6 million square kilometers of land and 56 ethnic groups. Whose model can we follow? Who can tell us what to do? We should be inclusive and learn from others' good things with an open mind. We should digest and absorb others' good things from an independent standpoint and turn them into our own good things. However, we must not swallow them whole or imitate others blindly. It is not feasible to copy and paste the political system of other countries. It will not adapt to the local conditions, it will not achieve the desired effect, and it may even ruin the future and destiny of the country. Only the system that is rooted in the soil of the country and draws abundant nutrients is the most reliable and effective.

The theoretical system of socialism with Chinese characteristics is the correct theory to guide the party and the people to achieve the great rejuvenation of the Chinese nation. The socialist system with Chinese characteristics is the fundamental institutional guarantee for the development and progress of contemporary China. The socialist culture with Chinese characteristics is a powerful spiritual force that inspires the whole party and the people of all ethnic groups in the country to forge ahead. 法治兴则国兴，法治强则国强。网络法治是信息革命发展的时代需求，是网络强国建设的重要保障。2024年是习近平总书记提出网络强国战略目标10周年，是我国全功能接入国际互联网30周年，也是我国网络法治建设起步30周年。30年来，我国互联网走过了波澜壮阔的发展历程。特别是党的十八大以来，在以习近平同志为核心的党中央坚强领导下，我国将依法治网作为全面依法治国和网络强国建设的重要内容，深入推进网络空间法治化，有力推动网络法治高质量发展，走出了一条中国特色依法治网之路，为网络强国建设提供了坚强有力服务保障。
一、深入学习领会习近平总书记关于网络法治的重要论述，认真总结我国网络法治工作的成就经验
党的十八大以来，习近平总书记深刻把握信息时代的“时”与“势”，高度重视网络法治工作，将依法治网纳入全面依法治国和网络强国建设全局，围绕依法治网这一重大时代课题，作出一系列重要论述，强调互联网这块“新疆域”不是“法外之地”，同样要讲法治，同样要维护国家主权、安全、发展利益；强调要把依法治网作为基础性手段，继续加快制定完善互联网领域法律法规，推动依法管网、依法办网、依法上网，确保互联网在法治轨道上健康运行；强调要本着对社会负责、对人民负责的态度，依法加强网络空间治理，依法严厉打击网络黑客、电信网络诈骗、侵犯公民个人隐私等违法犯罪行为，维护公民在网络空间的合法权益；强调要深入实施网络安全法，以良法善治保障新业态新模式健康发展，要抓紧制定立法规划，完善互联网信息内容管理、关键信息基础设施保护等法律法规，依法加强网络社会管理；强调中国愿同各国一道，推动制定各方普遍接受的网络空间国际规则，健全打击网络犯罪司法协助机制，共同维护网络空间和平安全；等等。总书记的重要论述思想深邃、内涵丰富，明确了网络法治在党和国家事业全局中的重要地位、战略目标、原则要求、国际主张和基本方法，是习近平法治思想和习近平总书记关于网络强国的重要思想的重要组成部分，为做好新时代网络法治工作提供了根本遵循和行动指南。
自1994年全功能接入国际互联网以来，我国高度重视网络法治建设，不断探索符合我国互联网发展特点的依法治网之路。特别是党的十八大以来，在以习近平同志为核心的党中央坚强领导下，在习近平新时代中国特色社会主义思想的科学指引下，我国网络法治建设取得了一系列显著成就。

加强顶层设计，网络法律体系不断健全。坚持科学立法、民主立法、依法立法，大力推进网络法律制度建设，持续夯实网络空间法治基础，网络立法的系统性、整体性、协同性、时效性不断增强。制定出台网络领域立法150余部，基本形成以宪法为根本，以法律、行政法规、部门规章和地方性法规、地方政府规章为依托，以传统立法为基础，以网络内容建设与管理、网络安全、信息化等网络专门立法为主干的网络法律体系，为网络强国建设提供坚实制度保障。
加强法治实施，网络执法司法持续深化。坚持严格规范公正文明网络执法，深入推进网络执法体制机制改革，持续深入开展“清朗”、“净网”、“护苗”等系列专项行动，加大对人民群众反映强烈的网络淫秽色情、虚假信息、未成年人沉迷网络等治理力度，加强网络安全、数据安全、个人信息保护以及网络交易、网络知识产权执法。支持深入推进网络司法，明确在线诉讼、在线调解、在线运行、电子数据证据以及网络案件法律适用规则，相继设立杭州、北京、广州互联网法院，助力推进数字检察工作，强化大数据赋能法律监督。依法解决新型网络纠纷，打击网络犯罪，深化网络空间合法权益司法保护，有力捍卫网络空间公平正义。
加强宣传教育，网络法治意识和素养全面提升。不断深化网络法治宣传，深入开展网络法治理论研究和教育，尊法学法守法用法日益成为网络空间广泛共识和基本准则。丰富网络法治宣传载体形式，建强网络法治宣传矩阵，网络法治宣传质效全面提升。持续深化宪法宣传周、民法典宣传月、国家网络安全宣传周等主题宣传，创新开展全国法治动漫微视频作品征集、“全国网络普法行”、“全国网信普法进校园”等品牌活动。加快形成理论与实践相结合、制度与发展相适应的网络法治教育研究、人才培养机制，为网络法治建设提供智力支持和人才保障。
加强务实合作，网络法治国际交流合作深入推进。坚持以习近平总书记关于构建网络空间命运共同体的理念主张为指引，积极参与网络空间国际规则制定，以国际良法促进全球善治。支持发挥联合国在网络空间国际治理中的主渠道作用，助推制定网络安全文化宣言文件和电子商务、电子签名等领域示范法。发布《携手构建网络空间命运共同体行动倡议》、《全球数据安全倡议》、《全球安全倡议概念文件》、《全球人工智能治理倡议》，持续深化网络法治国际合作理念。搭建世界互联网大会等对话合作平台和交流机制。强化国际网络执法司法合作，开展未成年人网络保护、打击网络恐怖主义和电信网络诈骗等务实合作。
这些成绩的取得，根本在于习近平总书记作为党中央的核心、全党的核心掌舵领航，在于习近平新时代中国特色社会主义思想特别是习近平法治思想、习近平总书记关于网络强国的重要思想科学指引。网络法治建设走过的不平凡历程，彰显了我们党厉行法治、奉法强国的坚定决心，体现了坚定不移走中国特色治网之道的坚强意志，凝聚着党领导网络法治建设的经验和智慧。这些宝贵经验包括：必须坚持以习近平新时代中国特色社会主义思想统领网络法治工作全局，切实用党的创新理论武装头脑、指导实践、推动工作；必须坚持党管互联网，加强党对网络法治工作的全面领导，深刻领悟“两个确立”的决定性意义，坚决做到“两个维护”，确保网络法治工作始终沿着正确方向前进；必须坚持以人民为中心的发展思想，把体现人民利益、反映人民愿望、维护人民权益、增进人民福祉落实到网络法治建设全过程各方面；必须坚持走中国特色依法治网之路，探索符合国情、民情、网情的依法治网模式；必须坚持把握网络法治工作规律，做到依法治网和以德润网相统一、高质量发展和高水平安全相协调、国内法治和涉外法治相衔接；必须坚持推进网络法治工作创新，深入推进网络法治理念思路、工作内容、方式手段、体制机制等全方位创新；必须坚持凝聚网络法治工作合力，统筹兼顾、把握重点、整体谋划，形成网络法治全国“一盘棋”；等等。这些宝贵经验要长期坚持，并在实践中不断丰富和发展。
二、准确把握网络法治建设面临的新形势新任务，切实增强推进新时代网络法治建设的责任感使命感紧迫感
2023年7月，习近平总书记对网络安全和信息化工作作出重要指示，赋予网信工作“举旗帜聚民心、防风险保安全、强治理惠民生、增动能促发展、谋合作图共赢”的使命任务。当前，以互联网为代表的信息技术日新月异，引领了社会生产新变革，创造了人类生活新空间，拓展了国家治理新领域。与此同时，互联网在快速发展的过程中也面临一系列新课题，新技术新应用层出不穷、新情况新问题不断涌现，网络法治建设面临一系列新形势新任务新挑战，在党和国家事业发展全局特别是网络强国建设新征程中的作用日益凸显。
高质量发展明确新任务。信息革命时代潮流正加速向经济社会各领域广泛渗透，数字化、网络化、智能化深入演进，从根本上改变了传统生产方式和发展模式，成为驱动经济社会高质量发展的关键引擎。人工智能、大数据、云计算等新技术新应用快速发展，催生一系列新业态新模式，为推动互联网健康发展提出了许多新课题。这就要求我们充分发挥网络法治在推动信息化发展中的规范引领、保驾护航作用，坚持促进发展和依法管理相统一，积极利用法律法规引导新技术新应用，以良法善治保障新业态新模式健康发展，切实为以信息化数字化驱动高质量发展提供可靠法治保障。
网络空间面临新挑战。网络安全已成为最复杂、最现实、最严峻的非传统安全问题之一。关键信息基础设施网络安全问题突出，网络攻击威胁上升，事故隐患易发多发，各类网络违法犯罪活动时有发生，颠覆性技术加速创新迭代，技术安全风险变量频现，数据安全成为事关国家安全与经济社会发展的重大问题，加强数据安全工作日益紧迫。这就要求我们更好统筹发展和安全，进一步健全网络空间法律制度，加快提升网络安全和数据安全防护能力，坚决守住安全底线，切实以网络法治推动高质量发展和高水平安全良性互动。
人民群众提出新期待。互联网已经成为人民群众生产生活的新空间，人民群众对清朗网络空间的期待愈加迫切。而与人民群众期待相比，网络空间还存在一些侵害人民群众合法权益的问题，网络水军、网络暴力等有待深化治理，侵犯个人信息权益现象依然存在，人民群众对此反映强烈。这就要求我们把体现人民利益、反映人民愿望、维护人民权益作为网络法治工作的出发点和落脚点，突出抓好人民群众“急难愁盼”问题的依法治理，切实维护人民群众网络合法权益，让人民群众在互联网发展中有更多获得感、幸福感、安全感。

三、全面推进网络法治高质量发展，切实筑牢网络强国建设法治根基
推进依法治网是全面依法治国的必然要求，是加快建设网络强国的必然要求。新征程上，要深入学习贯彻习近平新时代中国特色社会主义思想特别是习近平法治思想、习近平总书记关于网络强国的重要思想，加强党对网络法治工作的全面领导，全面推进网络法治高质量发展，不断完善中国特色网络法治体系。建设更加完备的网络法律规范体系，进一步形成中央立法和地方立法相结合、国内立法和国际规则相协调、传统立法和专门立法相衔接，覆盖信息化发展、网络安全、网络内容建设与管理等多个领域的网络法律体系；建设更加高效的网络法治实施体系，深入推进网络执法协调机制建设，推进严格规范公正文明网络执法，健全适应互联网发展治理新特点的监督管理执法措施，准确把握互联网发展司法需求，依法妥善处理涉网案件，拓展网络普法新格局，加强优质内容供给；建设更加严密的网络法治监督体系，完善权力运行制约和监督机制，健全网络执法监督检查工作体系，推动网络执法全方位、全流程、常态化、长效化监督；建设更加有力的网络法治保障体系，完善党领导依法治网的制度机制，加强网络法治专门队伍建设，以网络法治新成效为阔步迈向网络强国提供坚强有力服务保障。
以网络法治新成效有力保障高质量发展。加快完善网络基础设施法治保障，不断健全信息化发展法律法规，护航网信领域科技自立自强，努力为数字化、网络化、智能化融合发展营造一流法治环境。加快完善网络领域产权保护、公平竞争、社会信用等制度，促进资本、技术、数据等要素进一步依法有序自由流动。加快推进数字经济、人工智能、网络平台、大数据、云计算等新兴领域立法，为新质生产力发展提供制度保障。

When the rule of law is prosperous, the country is prosperous; when the rule of law is strong, the country is strong. Cyber law is the demand of the times for the development of the information revolution and an important guarantee for the construction of a cyber power. 2024 marks the 10th anniversary of General Secretary Xi Jinping's proposal of the strategic goal of building a cyber power, the 30th anniversary of my country's full-function access to the international Internet, and the 30th anniversary of the start of my country's cyber law construction. Over the past 30 years, my country's Internet has gone through a magnificent development process. Especially since the 18th National Congress of the Communist Party of China, under the strong leadership of the Party Central Committee with Comrade Xi Jinping as the core, my country has taken the rule of law in the Internet as an important part of the comprehensive rule of law and the construction of a cyber power, and has deeply promoted the rule of law in cyberspace, vigorously promoted the high-quality development of cyber law, and embarked on a path of rule of law in the Internet with Chinese characteristics, providing strong and powerful service guarantees for the construction of a cyber power.
1. Deeply study and understand General Secretary Xi Jinping's important expositions on cyber rule of law, and conscientiously summarize the achievements and experiences of my country's cyber rule of law work
Since the 18th CPC National Congress, General Secretary Xi Jinping has profoundly grasped the "time" and "trend" of the information age, attached great importance to cyber rule of law work, and incorporated the rule of law on the Internet into the overall situation of comprehensively governing the country according to law and building a cyber power. He has made a series of important expositions around the major contemporary issue of the rule of law on the Internet, emphasizing that the Internet, a "new territory", is not a "lawless place", and that the rule of law should also be observed, and that national sovereignty, security, and development interests should also be safeguarded; emphasizing that the rule of law on the Internet should be taken as a basic means, and that the formulation and improvement of laws and regulations in the field of the Internet should be continued to be accelerated, and that the Internet management, operation, and access to the Internet should be promoted in accordance with the law, and that the Internet should be managed, operated, and accessed in accordance with the law. They clarify the important position, strategic goals, principles, requirements, international propositions and basic methods of cyber rule of law in the overall cause of the Party and the country. They are an important part of Xi Jinping's rule of law thought and General Secretary Xi Jinping's important thoughts on cyber power, and provide a fundamental guideline and action guide for doing a good job in cyber rule of law in the new era.
Since the full-function access to the international Internet in 1994, my country has attached great importance to the construction of cyber rule of law and constantly explored the path of governing the Internet according to law that conforms to the characteristics of my country's Internet development. Strengthen the top-level design, and continuously improve the cyber law system. Adhere to scientific legislation, democratic legislation, and legislation in accordance with the law, vigorously promote the construction of cyber law system, and continue to consolidate the legal foundation of cyberspace. The systematic, holistic, coordinated and timely nature of cyber legislation has been continuously enhanced. More than 150 pieces of legislation in the cyber field have been formulated and issued, and a cyber law system has basically been formed with the Constitution as the foundation, laws, administrative regulations, departmental regulations and local regulations, local government regulations as the support, traditional legislation as the basis, and network content construction and management, network security, informatization and other network-specific legislation as the main body, providing a solid institutional guarantee for the construction of a cyber power.
Strengthen the implementation of the rule of law, and continue to deepen cyber law enforcement and justice. Adhere to strict, standardized, fair and civilized network law enforcement, deepen the reform of the network law enforcement system and mechanism, continue to carry out a series of special actions such as "clear and bright", "clean network", and "protect seedlings", increase the governance of online pornography, false information, and minors' addiction to the Internet, which are strongly reflected by the people, and strengthen network security, data security, personal information protection, and network transactions and network intellectual property law enforcement. Support the in-depth promotion of network justice, clarify the rules for online litigation, online mediation, online operation, electronic data evidence, and the application of laws in network cases, successively establish Hangzhou, Beijing, and Guangzhou Internet Courts, help promote digital prosecution work, and strengthen big data empowerment of legal supervision. Resolve new types of network disputes in accordance with the law, crack down on cybercrime, deepen judicial protection of legitimate rights and interests in cyberspace, and effectively defend fairness and justice in cyberspace.
Strengthen publicity and education, and comprehensively improve network rule of law awareness and literacy. Continuously deepen network rule of law publicity, carry out in-depth research and education on network rule of law theory, and respect, learn, abide by, and use the law are increasingly becoming a broad consensus and basic norm in cyberspace. Enrich the forms of network rule of law publicity carriers, build a strong network rule of law publicity matrix, and comprehensively improve the quality and effectiveness of network rule of law publicity. We will continue to deepen thematic publicity such as the Constitution Publicity Week, the Civil Code Publicity Month, and the National Cybersecurity Publicity Week, and innovatively carry out brand activities such as the national legal animation micro-video collection, the "National Internet Legal Education Tour", and the "National Internet Information Legal Education into Campus". We will accelerate the formation of a network legal education research and talent training mechanism that combines theory with practice and adapts the system to development, and provide intellectual support and talent guarantee for the construction of network legal system.
Strengthen practical cooperation, and deepen international exchanges and cooperation on network legal system. We will adhere to the guidance of General Secretary Xi Jinping's ideas and propositions on building a community with a shared future in cyberspace, actively participate in the formulation of international rules for cyberspace, and promote global good governance with international good laws. We will support the United Nations in playing the leading role in international cyberspace governance, and promote the formulation of cybersecurity culture declaration documents and model laws in the fields of e-commerce and electronic signatures. II. Accurately grasp the new situation and new tasks facing the construction of cyber rule of law, and effectively enhance the sense of responsibility, mission and urgency of promoting the construction of cyber rule of law in the new era
In July 2023, General Secretary Xi Jinping made important instructions on cyber security and informatization work, and entrusted cyber security work with the mission and task of "raising the banner to gather people's hearts, preventing risks and ensuring safety, strengthening governance to benefit people's livelihood, increasing momentum to promote development, and seeking cooperation and win-win results". At present, information technology represented by the Internet is changing with each passing day, leading to new changes in social production, creating new space for human life, and expanding new areas of national governance. At the same time, the Internet is also facing a series of new topics in the process of rapid development. New technologies and new applications are emerging in an endless stream, and new situations and new problems are constantly emerging. The construction of cyber rule of law faces a series of new situations, new tasks and new challenges, and its role in the overall development of the party and the country, especially in the new journey of building a cyber power, is becoming increasingly prominent.
High-quality development clarifies new tasks. The trend of the information revolution era is accelerating its widespread penetration into all areas of the economy and society. Digitalization, networking, and intelligence are evolving in depth, fundamentally changing the traditional mode of production and development model, and becoming a key engine driving high-quality economic and social development. The rapid development of new technologies and applications such as artificial intelligence, big data, and cloud computing has spawned a series of new business forms and models, and has raised many new issues for promoting the healthy development of the Internet. This requires us to give full play to the role of cyber law in promoting the development of informatization, leading and protecting the norms, adhering to the unity of promoting development and managing according to law, actively using laws and regulations to guide new technologies and applications, and ensuring the healthy development of new business forms and models with good laws and good governance, and effectively providing reliable legal guarantees for high-quality development driven by informatization and digitalization.
Cyberspace faces new challenges. Cybersecurity has become one of the most complex, realistic, and severe non-traditional security issues. The cybersecurity issues of key information infrastructure are prominent, the threat of cyber attacks is increasing, accidents are prone to occur frequently, various types of network crimes occur from time to time, disruptive technologies accelerate innovation and iteration, technical security risk variables appear frequently, data security has become a major issue related to national security and economic and social development, and strengthening data security work is becoming increasingly urgent. This requires us to better coordinate development and security, further improve the legal system of cyberspace, accelerate the improvement of cybersecurity and data security protection capabilities, resolutely defend the bottom line of security, and effectively promote high-quality development and high-level security benign interaction with cyber law.
The people have new expectations. The Internet has become a new space for people's production and life, and people's expectations for a clear cyberspace are becoming more urgent. Compared with people's expectations, there are still some problems in cyberspace that infringe on people's legitimate rights and interests. Internet water army and cyber violence need to be further governed, and the phenomenon of infringing personal information rights and interests still exists, and people have strong reactions to this. This requires us to reflect the interests of the people, reflect the wishes of the people, and safeguard the rights and interests of the people as the starting point and foothold of cyber law work, focus on the legal governance of the "urgent, difficult, and anxious" problems of the people, and effectively safeguard the legitimate rights and interests of the people on the Internet, so that the people have more sense of gain, happiness, and security in the development of the Internet.

III. Comprehensively promote the high-quality development of cyber rule of law and lay a solid legal foundation for the construction of a cyber power
Promoting the rule of law in the Internet is an inevitable requirement for the comprehensive rule of law and the acceleration of the construction of a cyber power. On the new journey, we must thoroughly study and implement Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, especially Xi Jinping's Thought on the Rule of Law and General Secretary Xi Jinping's important thoughts on cyber power, strengthen the Party's overall leadership over cyber rule of law work, comprehensively promote the high-quality development of cyber rule of law, and continuously improve the cyber rule of law system with Chinese characteristics.
