On 7 March 2025, led by the Cyberspace Administration of China, Chinese authorities issued a notice of promulgation of 《人工智能生成合成内容标识办法》[Measures for Identifying Synthetic Content Generated by Artificial Intelligence] to be effective 1 September 2025. They are worth careful study as an additional layer of regulatory oversight of A.I. generated content, the main thrust of which is to ensure that the State (with the Party at its core) is not sidelined by developments in A-I. generated content. That aligns with the general foundational premise of socialist modernization after the 3rd Plenum of the 20th Party Congress, a central rationalizing premise of which was that modernization could only exist with the CPC in the lead, that this lead could be undertaken where the CPC drove new quality productivity, and that the generative element of this driving force of socialist modernization was necessarily the exercise of coordination as well as direction by or through the CPC core and then its apparatus (Economic Dialectics Must be Coordinated! Brief Reflections on 习近平, 经济工作必须统筹好几对重要关系 [Xi Jinping, "Economic work must coordinate several important relationships"] and Marxist-Leninist Phenomenology in Socialist Modernization). But it was more than that. The measures were characterized as responding to mass disquiet and concerns, and pointed toward the elimination of informaiton and actions that threatened not just the masses but the orderly development of this technology and the stability of the state. The Press Release stated it this way:
In recent years, new technologies such as generative artificial intelligence and deep synthesis have developed rapidly, providing convenient tools for generating synthetic text, pictures, audio, video and other information. While promoting economic development, enriching online content, and facilitating public life, it also causes problems such as the spread of false information and the destruction of the network ecology. The society has widely called for accelerating special legislation, strengthening technical supervision, and consolidating platform responsibilities. In order to actively respond to social concerns and the concerns of the masses, the Cyberspace Administration of China, together with the Ministry of Industry and Information Technology, the Ministry of Public Security, and the State Administration of Radio and Television, has formulated the "Identification Measures". A key element of this structure are information spokes built around institutional and regulatory hubs. Their construction and operation, in turn, requires data; and high quality data requires disclosure of key element of productivity that may be available to the vanguard and on which it may rely in guiding socialist modernization through its current era of historical development. That data consists, in this case, if origin identifiers which provides a basis for enhancing development. Article 1 speaks to this in these terms:

The disclosure regulations add a layer on an already layered regulatory system that includes: 《中华人民共和国网络安全法》、《互联网信息服务算法推荐管理规定》、《互联网信息服务深度合成管理规定》、《生成式人工智能服务管理暂行办法》等法律 [the Cybersecurity Law of the People's Republic of China, the Regulations on the Administration of Algorithm Recommendation of Internet Information Services, the Regulations on the Administration of Deep Synthesis of Internet Information Services, the Interim Measures for the Administration of Generative Artificial Intelligence Services and other laws].
Article 2 provides that the measures apply broadly to a range of generators and providers generally subject to the web of cyber regulations already issued and referenced in Article 1. Article 3 then specifies the two forms of identification required:
Explicit identification refers to identification added in the generation of synthetic content or interactive scene interface, which is presented in the form of text, sound, graphics, etc. and can be clearly perceived by users. Implicit identification refers to identification added in the generation of synthetic content file data by taking technical measures, which is not easily perceived by users. [显式标识是指在生成合成内容或者交互场景界面中添加的,以文字、声音、图形等方式呈现并可以被用户明显感知到的标识。隐式标识是指采取技术措施在生成合成内容文件数据中添加的,不易被用户明显感知到的标识。]These are then elaborated in requirements for different entities subject to the measures. Public disclosure of the use of such content is required in service provider agreements (e.g., Articles 8-9). Article 13 leaves it to regulatory agencies to develop penalties and other measures where there are compliance failures.
It stands to reason that such reporting may be accessed by the State and its relevant organs, and will likely be used through the State's own A.I. assisted programs to generate the sort of descriptive and predictive models that will be critical to the State if it is to undertake its coordination and guidance rule with any degree of relevance. It is not clear if the measures also apply to State and Party organs. One might suspect that for reasons of national security and state secrets it might not. The measures may apply to context producers from abroad whose content circulates in China. It is less clear whether content generation subject to these rules will also apply to State enterprises and private entities operating abroad with respect to that content, and whether such information would be available to hist state regulators.
Of particular interest will be the way that the Chinese content identification rules will align with the transparency rules of the E.U. A.I. Act, for example Arts. 12-14, and Chapter V. The Ai.I. Act's preamble (¶27) provides: "Transparency means that AI systems are developed and used in a way that allows appropriate traceability and explainability, while making humans aware that they communicate or interact with an AI system, as well as duly informing deployers of the capabilities and limitations of that AI system and affected persons about their rights."

人工智能生成合成内容标识办法
第一条 为了促进人工智能健康发展,规范人工智能生成合成内容标识,保护公民、法人和其他组织合法权益,维护社会公共利益,根据《中华人民共和国网络安全法》、《互联网信息服务算法推荐管理规定》、《互联网信息服务深度合成管理规定》、《生成式人工智能服务管理暂行办法》等法律、行政法规和部门规章,制定本办法。
第二条 符合《互联网信息服务算法推荐管理规定》、《互联网信息服务深度合成管理规定》、《生成式人工智能服务管理暂行办法》规定情形的网络信息服务提供者(以下简称“服务提供者”)开展人工智能生成合成内容标识活动,适用本办法。
第三条 人工智能生成合成内容是指利用人工智能技术生成、合成的文本、图片、音频、视频、虚拟场景等信息。
人工智能生成合成内容标识包括显式标识和隐式标识。
显式标识是指在生成合成内容或者交互场景界面中添加的,以文字、声音、图形等方式呈现并可以被用户明显感知到的标识。
隐式标识是指采取技术措施在生成合成内容文件数据中添加的,不易被用户明显感知到的标识。
第四条 服务提供者提供的生成合成服务属于《互联网信息服务深度合成管理规定》第十七条第一款情形的,应当按照下列要求对生成合成内容添加显式标识:
(一)在文本的起始、末尾或者中间适当位置添加文字提示或者通用符号提示等标识,或者在交互场景界面、文字周边添加显著的提示标识;
(二)在音频的起始、末尾或者中间适当位置添加语音提示或者音频节奏提示等标识,或者在交互场景界面中添加显著的提示标识;
(三)在图片的适当位置添加显著的提示标识;
(四)在视频起始画面和视频播放周边的适当位置添加显著的提示标识,可以在视频末尾和中间适当位置添加显著的提示标识;
(五)呈现虚拟场景时,在起始画面的适当位置添加显著的提示标识,可以在虚拟场景持续服务过程中的适当位置添加显著的提示标识;
(六)其他生成合成服务场景根据自身应用特点添加显著的提示标识。
服务提供者提供生成合成内容下载、复制、导出等功能时,应当确保文件中含有满足要求的显式标识。
第五条 服务提供者应当按照《互联网信息服务深度合成管理规定》第十六条的规定,在生成合成内容的文件元数据中添加隐式标识,隐式标识包含生成合成内容属性信息、服务提供者名称或者编码、内容编号等制作要素信息。
鼓励服务提供者在生成合成内容中添加数字水印等形式的隐式标识。
文件元数据是指按照特定编码格式嵌入到文件头部的描述性信息,用于记录文件来源、属性、用途等信息内容。
第六条 提供网络信息内容传播服务的服务提供者应当采取下列措施,规范生成合成内容传播活动:
(一)核验文件元数据中是否含有隐式标识,文件元数据明确标明为生成合成内容的,采取适当方式在发布内容周边添加显著的提示标识,明确提醒公众该内容属于生成合成内容;
(二)文件元数据中未核验到隐式标识,但用户声明为生成合成内容的,采取适当方式在发布内容周边添加显著的提示标识,提醒公众该内容可能为生成合成内容;
(三)文件元数据中未核验到隐式标识,用户也未声明为生成合成内容,但提供网络信息内容传播服务的服务提供者检测到显式标识或者其他生成合成痕迹的,识别为疑似生成合成内容,采取适当方式在发布内容周边添加显著的提示标识,提醒公众该内容疑似生成合成内容;
(四)提供必要的标识功能,并提醒用户主动声明发布内容中是否包含生成合成内容。
有前款第一项至第三项情形的,应当在文件元数据中添加生成合成内容属性信息、传播平台名称或者编码、内容编号等传播要素信息。
第七条 互联网应用程序分发平台在应用程序上架或者上线审核时,应当要求互联网应用程序服务提供者说明是否提供人工智能生成合成服务。互联网应用程序服务提供者提供人工智能生成合成服务的,互联网应用程序分发平台应当核验其生成合成内容标识相关材料。
第八条 服务提供者应当在用户服务协议中明确说明生成合成内容标识的方法、样式等规范内容,并提示用户仔细阅读并理解相关的标识管理要求。
第九条 用户申请服务提供者提供没有添加显式标识的生成合成内容的,服务提供者可以在通过用户协议明确用户的标识义务和使用责任后,提供不含显式标识的生成合成内容,并依法留存提供对象信息等相关日志不少于六个月。
第十条 用户使用网络信息内容传播服务发布生成合成内容的,应当主动声明并使用服务提供者提供的标识功能进行标识。
任何组织和个人不得恶意删除、篡改、伪造、隐匿本办法规定的生成合成内容标识,不得为他人实施上述恶意行为提供工具或者服务,不得通过不正当标识手段损害他人合法权益。
第十一条 服务提供者开展标识活动的,还应当符合相关法律、行政法规、部门规章和强制性国家标准的要求。
第十二条 服务提供者在履行算法备案、安全评估等手续时,应当按照本办法提供生成合成内容标识相关材料,并加强标识信息共享,为防范打击相关违法犯罪活动提供支持和帮助。
第十三条 违反本办法规定的,由网信、电信、公安和广播电视等有关主管部门依据职责,按照有关法律、行政法规、部门规章的规定予以处理。
第十四条 本办法自2025年9月1日起施行。

Measures for the Identification of Synthetic Content Generated by Artificial Intelligence
Article 1 In order to promote the healthy development of artificial intelligence, standardize the identification of synthetic content generated by artificial intelligence, protect the legitimate rights and interests of citizens, legal persons and other organizations, and safeguard the public interest, these Measures are formulated in accordance with the Cybersecurity Law of the People's Republic of China, the Regulations on the Administration of Algorithm Recommendation of Internet Information Services, the Regulations on the Administration of Deep Synthesis of Internet Information Services, the Interim Measures for the Administration of Generative Artificial Intelligence Services and other laws, administrative regulations and departmental regulations.
Article 2 These Measures shall apply to network information service providers (hereinafter referred to as "service providers") that meet the circumstances specified in the Regulations on the Administration of Algorithm Recommendation of Internet Information Services, the Regulations on the Administration of Deep Synthesis of Internet Information Services and the Interim Measures for the Administration of Generative Artificial Intelligence Services when carrying out the identification of synthetic content generated by artificial intelligence.
Article 3 Synthetic content generated by artificial intelligence refers to information such as text, pictures, audio, video, virtual scenes, etc. generated and synthesized using artificial intelligence technology.
The identification of synthetic content generated by artificial intelligence includes explicit identification and implicit identification.
Explicit identification refers to identification added in the generation of synthetic content or interactive scene interface, which is presented in the form of text, sound, graphics, etc. and can be clearly perceived by users.
Implicit identification refers to identification added in the generation of synthetic content file data by taking technical measures, which is not easily perceived by users.
Article 4 Where the generation and synthesis service provided by the service provider falls under the first paragraph of Article 17 of the "Regulations on the Management of Deep Synthesis of Internet Information Services", the service provider shall add explicit identification to the generation and synthesis content in accordance with the following requirements:
(i) Add text prompts or general symbol prompts at the beginning, end or appropriate position in the middle of the text, or add prominent prompts in the interactive scene interface or around the text;
(ii) Add voice prompts or audio rhythm prompts at the beginning, end or appropriate position in the middle of the audio, or add prominent prompts in the interactive scene interface;
(iii) Add prominent prompts at appropriate positions in the picture;
(iv) Add prominent prompts at appropriate positions in the video start screen and around the video playback, and may add prominent prompts at the end and appropriate positions in the middle of the video;
(v) When presenting a virtual scene, add prominent prompts at appropriate positions in the starting screen, and may add prominent prompts at appropriate positions during the continuous service of the virtual scene;
(vi) Other generation and synthesis service scenarios add prominent prompts according to their own application characteristics.
When a service provider provides functions such as downloading, copying, and exporting generated synthetic content, it shall ensure that the file contains explicit identification that meets the requirements.
Article 5 Service providers shall add implicit identification to the file metadata of generated synthetic content in accordance with Article 16 of the "Regulations on the Management of Deep Synthesis of Internet Information Services". The implicit identification includes production element information such as the attribute information of the generated synthetic content, the name or code of the service provider, and the content number.
Service providers are encouraged to add implicit identification in the form of digital watermarks in the generated synthetic content.
File metadata refers to descriptive information embedded in the file header in a specific encoding format, which is used to record information such as the source, attributes, and purpose of the file.
Article 6 Service providers providing network information content dissemination services shall take the following measures to regulate the dissemination of generated synthetic content:
(i) Verify whether there are implicit identifiers in the file metadata. If the file metadata clearly indicates that it is generated synthetic content, take appropriate measures to add prominent prompt identifiers around the published content to clearly remind the public that the content is generated synthetic content;
(ii) If no implicit identifier is verified in the file metadata, but the user declares that it is generated synthetic content, take appropriate measures to add prominent prompt identifiers around the published content to remind the public that the content may be generated synthetic content;
(iii) If no implicit identifier is verified in the file metadata and the user does not declare that it is generated synthetic content, but the service provider providing network information content dissemination services detects explicit identifiers or other generation and synthesis traces, it is identified as suspected generated synthetic content, and take appropriate measures to add prominent prompt identifiers around the published content to remind the public that the content is suspected to be generated synthetic content;
(iv) Provide necessary identification functions and remind users to actively declare whether the published content contains generated synthetic content.
In the case of the first to third items of the preceding paragraph, the information on the dissemination elements such as the attribute information of the generated synthetic content, the name or code of the dissemination platform, and the content number shall be added to the file metadata.
Article 7 When the Internet application distribution platform puts the application on the shelf or reviews it online, it shall require the Internet application service provider to explain whether it provides artificial intelligence generated synthesis services. If the Internet application service provider provides artificial intelligence generated synthesis services, the Internet application distribution platform shall verify the relevant materials for its generated synthetic content identification.
Article 8 The service provider shall clearly state the method, style and other normative contents of the generated synthetic content identification in the user service agreement, and prompt the user to read and understand the relevant identification management requirements carefully.
Article 9 If the user applies to the service provider to provide generated synthetic content without adding explicit identification, the service provider may provide generated synthetic content without explicit identification after clarifying the user's identification obligations and use responsibilities through the user agreement, and retain relevant logs such as the information of the provided object for no less than six months in accordance with the law.
Article 10 If a user uses the network information content dissemination service to publish generated synthetic content, he shall actively declare and use the identification function provided by the service provider for identification.
No organization or individual shall maliciously delete, tamper with, forge or conceal the generated synthetic content identification specified in these Measures, shall not provide tools or services for others to carry out the above-mentioned malicious acts, and shall not damage the legitimate rights and interests of others through improper identification means.
Article 11 When service providers carry out identification activities, they shall also comply with the requirements of relevant laws, administrative regulations, departmental regulations and mandatory national standards.
Article 12 When performing procedures such as algorithm filing and security assessment, service providers shall provide relevant materials for generating synthetic content identification in accordance with these Measures, and strengthen the sharing of identification information to provide support and assistance for preventing and combating related illegal and criminal activities.
Article 13 Any violation of the provisions of these Measures shall be handled by the relevant competent departments such as the Internet Information Office, Telecommunications, Public Security Bureau and Radio and Television in accordance with their duties and in accordance with the provisions of relevant laws, administrative regulations and departmental regulations.
Article 14 These Measures shall come into force on September 1, 2025.
